
{"id":1484,"date":"2016-04-21T09:25:00","date_gmt":"2016-04-21T09:25:00","guid":{"rendered":"http:\/\/ratinglegis.eu\/en\/?p=1484"},"modified":"2025-11-18T09:47:09","modified_gmt":"2025-11-18T09:47:09","slug":"mushroom-stew","status":"publish","type":"post","link":"https:\/\/ratinglegis.eu\/en\/mushroom-stew\/","title":{"rendered":"Mushroom Stew"},"content":{"rendered":"<p>On 6 March 2016 the European Commission announced a <a href=\"http:\/\/europa.eu\/rapid\/press-release_IP-16-1261_en.htm\">fine of 5.2 million euros<\/a> on a supplier of fresh and canned vegetables from Spain\u2019s La Rioja region, <a href=\"http:\/\/www.riberebro.com\/nuestro-grupo\/conservas-vegetales\">Riberebro<\/a>, for running a price fixing and client sharing cartel in the European canned mushrooms market during more than a year.<\/p>\n<p>Regarding the same cartel, the European Commission adopted on 25 June 2014 (<a href=\"http:\/\/ec.europa.eu\/competition\/antitrust\/cases\/dec_docs\/39965\/39965_1431_7.pdf\">case AT.39965<\/a>) a settlement decision addressed to Bonduelle, Lut\u00e8ce and Prochamp (imposing a total 32 million euros in fines on Bonduelle and Prochamp; while Lut\u00e8ce received the requested immunity). Riberebro chose not to join the settlement.<\/p>\n<p>The cartel concerned canned mushrooms for private labels, sold by tenders to retailers or wholesalers in the food sector (e.g., self-service retailers or professional clients such as caterers).<\/p>\n<p>The cartel aimed at stabilising market shares and stopping price drops through a non-aggression agreement with a compensation system in case of transfer of clients; and certain minimum prices. To this end, the cartel members shared confidential information on offers, fixed minimum prices, assigned clients and agreed on volume targets.<\/p>\n<p>The Commission followed the so-called \u201chybrid\u201d procedure, which involves two decisions: the simplified one for the companies that accept the settlement and admit their participation in the cartel; and the standard one for the company that decides not to settle and continue with the ordinary procedure. As you will remember, the Commission\u2019s first \u201chybrid\u201d settlement procedure was in the <a href=\"http:\/\/europa.eu\/rapid\/press-release_IP-10-985_en.htm\">animal feed phosphates<\/a> cartel (2010).<\/p>\n<p>While we wait for the Riberebro Decision to be published we may look back at a Commission Decision of 8 January 1975 (<a href=\"http:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:31975D0077&amp;from=FR\">IV\/27039 \u2013 <em>Preserved mushrooms<\/em><\/a>) that also concerned canned mushrooms. The Commission fined five French producers and the National Export Association of Taiwan (<em>Ta\u00efwan Mushroom Packers United Export Corp<\/em>, TMPUEC) for agreeing on mushroom\u00a0 production and sales in Germany; and fixing prices and sharing clients there. Bizarrely, the five French producers committed to opening the French market for TMPUECis Taiwanese\u00a0 asparagus. Tit for tat or just a little favour?<\/p>\n<p>We wager that the announcement of Riberebro\u2019s high fine will give ideas to several companies in this sector, who may consider suing for damages. These are likely to be neighbours, since approximatively <a href=\"http:\/\/www.larioja.org\/innovacion\/es\/noticias\/noticia-innovacion\/gonzalez-menorca-resalta-papel-centro-tecnologico-champinon\">60% of Spain\u2019s mushroom production is concentrated in La Rioja<\/a>. The specific \u00a0interest of Riberebro\u2019s clients is even more obvious. Furthermore, all consumers are potential victims\u2026<\/p>\n<p>Last January, the Ministry of Justice published its <a href=\"http:\/\/www.mjusticia.gob.es\/cs\/Satellite\/Portal\/1292427769696?blobheader=application%2Fpdf&amp;blobheadername1=Content-Disposition&amp;blobheadername2=Grupo&amp;blobheadervalue1=attachment%3B+filename%3DPropuesta_de_Ley_de_la_Seccion_Especial_para_la_Trasposicion_de_la_Directiva_2014_104_UE__del_Parla.PDF&amp;blobheadervalue2=Docs_CGC_Secciones+especializadas\">proposal to implement the antitrust damages Directive 2014\/104\/EU<\/a>. The <a href=\"http:\/\/www.mjusticia.gob.es\/cs\/Satellite\/Portal\/es\/actividad-legislativa\/comision-general-codificacion\/quienes-somos\">General Codification Commission<\/a>\u2019s draft amends the Competition Act (LDC) and the Code of Civil Procedure (LEC). To start the parliamentary procedure, the proposal must get approval \u2013 be it with or without changes\u2013 by the Council of Ministers. Having regard to the current governmental situation the forecast is\u2026to be really patient.<\/p>\n<p>This post might have whet your appetite.
